Essay Guidance (3500 words): legal
You are required to review the following
scenario and reflect on the positive professional values that should be
implemented by members of the healthcare team in order to deliver quality care
to the patient:
‘Hugh Jones is 78 years old. He suffers from dementia and his
condition has recently deteriorated presenting in hospital with severe
confusion, aggressive behaviour and he had begun to soil himself. In
hospital no one seemed to know what was happening
and Hugh became more confused although he did have some lucid
moments. He kept on trying to get out of bed, kept shouting for his wife
Barbara, and as a result, cot sides were put up by the HCA working there. By
now, Hugh was soiling himself every day. He didn’t know where he was.
A nurse wrote on a piece of paper that he should keep quiet and lie still but
he could not read it because he did not have his glasses. For a few days, two
security guards sat next to his bed and he told Barbara in one of his lucid
times that he was scared he was going to be taken away - during the war he had
been evacuated and had found this very upsetting. On several occasions
Barbara found Hugh unshaven, wearing soiled clothes from the previous day with
dried on food. She felt upset as Hugh was normally meticulous about
personal hygiene. Hugh’s dentures went missing from his bedside and could
not be found and therefore he struggled to eat and was placed on a pureed diet
and started to often refuse food. Barbara asked if she could stay with him but
the staff said she couldn't because it would be disruptive for the other
patients and there would be nowhere for her to sit. Two days later, Barbara got
a phone call to say that Hugh had slipped over the cot sides and was badly
bruised. This was deeply upsetting for her. Discussions surrounding
Hugh’s discharge involved assessing his mental capacity and ability to provide
power of attorney. As Barbara didn’t know how to do this she was feeling
very stressed.'
You have been provided with a
scenario where the experience of professional values and care provided to the
patient are sub-optimal.
You will
need to use Driscoll's reflective model to reflect on this situation and
highlight positive professional values that you would expect to see being
implemented to provide safe and effective care. The purpose of this, is to
enable you to explore values based health care. This essay can be written in
the First Person or Passive voice….but there will still be a requirement for academic
writing and referencing within this essay.
This essay is essentially aimed to demonstrate
professionalism and values that we should expect to see being delivered by
members of the multiprofessional team in the given scenario. The aim is
to focus on the professional approach to deliver the care, rather than the
delivery of the care itself.
You MUST
incorporate:
·
Aspects of the NMC Code (2018)
·
NHS Constitution (2015)
·
NHS Values (DoH, 2015)
·
The 6Cs (DoH, 2012)
·
Ethics (beneficence, non-maleficence, justice
and autonomy (Beauchamp and Childress, 2013)) to demonstrate your
knowledge and understanding of the professional nature of nursing
·
Legal aspects of your chosen scenario e.g.
consent, mental capacity, legal framework around medicines.
·
Policy, standards and guidelines that inform
practice e.g. NICE, DoH, NMC, RCN, WHO, local policies
Structure of
the Essay:
Introduction:
This should signpost your reader to the key
issues that you will address in the essay. A brief description of the scenario,
and a confidentiality statement.
A definition of professionalism in nursing must
be discussed (Learning Outcome 1).
Discuss and rationalise the importance of
reflection in practice and introduce Driscoll's reflective model.
Main body:
Begin the reflection utilising Driscoll and
ensure each stage of the reflective framework is incorporated into the
assignment. Subheadings are useful to use for reflection, e.g. 'What', 'So
What', 'Now What'.
What?
Here you should highlight the professional care
that should have been provided to Hugh and his family.
So What?
An analysis of the event. This revolves around
understanding the context of what happened. Discuss which professional values
were neglected and should therefore have been demonstrated utilising the
evidence base which underpins this. This should include the following:
o
Explore the implications of the scenario in
relation to how this might impact on your feelings and subsequently your care
o
Consider the concept and importance of whistle
blowing
o
Explore the implications of the scenario in
relation to how aspects of the NMC Code, NHS Constitution and the 6 Cs
(Learning Outcome 1 and 3) would be vital to uphold whilst caring for this
patient
o
Consider the key concepts of professionalism,
advocacy and any legal and ethical aspects associated with the care that should
be provided, e.g. confidentiality, consent, mental capacity
o
Discuss relevant policies, procedures,
guidelines and research
o
Do not forget to include discussion on the multidisciplinary
team.
Now What?
How will you use what you have learnt in future
clinical practice? What are your recommendations for future clinical
practice?
Conclusion:
The essay should finish with a clear conclusion
which draws together the themes of the whole discussion and identifies with
learning outcomes 1 and 3. No new information should be included in the
conclusion.
