exemption for the use is strictly to the members of the native church.
Article 18 of the Universal Declaration of Human Rights (Schutter. 2014) states; every individual is entitled
to freedom of conscience, thought and religion. The freedom to change religion guaranteed alone, in a
community, in private or public manifestation of a religion of his choice. No individual should be
discriminated against the religion of choice.
Peyote, a hallucinogen is a controlled substance, was allowed for the use by the followers of the American
church; however, the church got followed by the Native Americans alone (Lee, & Shlain, 1992).
The court
decision triggered a series of other cases against states with individual suing for the members of the
congregation but not ethnic Native Indians. The rulings were the persons; with the judges deciding that the
first judgment not selectively applied to the Native alone: it is because people from other races have the
freedom of religion to join the church.
Peyote is a psychoactive alkaloid extracted from a small cactus that grows wildly in the Chihuahua desert.
The plant is found in Texas and Mexico, common among scrub along the lime settlements.
The mescaline
within the plant produces a broad range of effects including deep insight into one's spiritual side. The use of
peyote causes auditory and visual hallucinations. Many Native American tribes continue to use peyote as a
way to relieve pain that occurs after chewing the plant.
Ayahuasca is an Amazon plant mixture capable of inducing altered states of consciousness; it lasts 4 to 8
hours after ingestion. It is used as medicine and as a shamanic means of communication, typically in
ceremonies under the guidance of an experienced user (DeKorne, 2011). Drinking ayahuasca and singing
together take individuals into a healing and inspiring trance.
Native American tribes use peyote as a therapeutic drug for a wide variety of ailments. The alkaloid from
peyote is often used to relief pain in childbirth; reduce pain associated with a toothache or even with certain
types of skin diseases. According to the National Institute on Drug Abuse, most of the abusers experience
deep meditation like symptoms. Others encounter intense anxiety and hallucinations that could pose serious
risks on the behavioral outcome.
