Introduction

Canada and the United States are recognized as the epitome of democracy and human rights protection, but is this really the case? Most citizens who reside in these two countries may argue in favor of that statement, but this is not always the case, especially when we consider the minority groups. In Canada, immigration has become a social concern owing to the influx of immigrants from the Middle East and North Africa. As a result, many issues are closely linked to the subject of immigration, such as the legal processes and their rights. The North American countrys policy allows detainees access to reasonable opportunities in regard to consulting with lawyers before any form of eliciting evidence (Silverman & Molnar, 2016). The law states that everyone should be afforded the right to retain and ask for counsel. Nonetheless, the country also faces the problem of immigrants, where they have provisions for this right at the expense of the immigrant before immigration divisions and refugee board (Knowles, 2016). This paper will assume the position that detained migrants should have the right to counsel in any legal setting. Body Silverman and Molnar (2016) have elucidated that the right to counsel in regard to the enforcement of immigration laws is a topic that has elicited mixed reactions due to the complexities involved. For this reason, it is important that Canada develops policies and strategies that will ensure this right is enforced and provided to migrants in the most humane way possible. In Canada, the complexities involved with access to counsel for migrants stems from the fact that there are no constitutional protection for them under the amendments enacted for criminal defense (Silverman and Molnar, 2016). Typically, many countries, including Canada, afford defendants in their respective criminal justice systems with the right to an attorney, who is provided in case they cannot afford one. When it comes to migrants; however, the situation becomes especially complicated for them if they are facing deportation, as the authorities do not provide the opportunity to fair counsel.
