Following a review of Chapters 1-3 you will notice that the hypothetical attorney in the hypothetical case representing the hypothetical couple, Otis and Fiona Olman, has made a decision about where to file the lawsuit. In your own words, defend her decision and then explain why it would not be possible or appropriate to file the suit in Nebraska, for instance. Explain what facts must change to make this a case which could be filed in Nebraska. This will require a foundational understanding of the concept of personal jurisdiction. Discuss why these geographic jurisdictional decisions are important to both plaintiffs and defendants in every case. Finally, determine whether your state of residence uses The Federal Rules of Civil Procedure as a model for its own set of rules.
